The authorizing legislation for the Child and Adult Care Food Program (CACFP) is found at 42 U.S.C. 1766, and the federal regulations that govern the CACFP are found at 7 C.F.R. Part 226. While 7 C.F.R. Part 226 is prescriptive in many of its requirements, it does allow states flexibility to implement certain requirements. The Nutrition Services Branch of the Division of Public Health, Department of Health and Human Services has seen the need to promulgate state rules to ensure consistency and uniformity in the administration and enforcement of the program across the State.
